Purchase rules
1. General Provisions
These terms and conditions (hereinafter – the “Rules”) define the mutual rights, duties, and responsibilities of the person purchasing goods (fermented products) from the bactohouse.eu online store (hereinafter – the “Buyer”) and MB Health Products, company code 305806087 (hereinafter – the “Seller”). By purchasing goods from the online store, the Buyer agrees to these Rules.
2. Conclusion of Contract
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer creates a shopping cart, specifies the delivery address, selects the delivery method, agrees to these Rules, chooses the payment method, clicks the “I confirm the order” button, and remains valid until all obligations under this contract are fulfilled. If the Buyer does not agree with all or part of these Rules, they should not place an order.
2.2. Each contract between the Buyer and the Seller is stored in the bactohouse.eu database.
3. Buyer’s Rights
3.1. The Buyer has the right to purchase goods from the online store in accordance with these Rules and the laws of the Republic of Lithuania.
3.2. The Buyer can cancel the purchase contract within 24 hours of purchase, before the goods are dispatched, due to:
- 3.2.1. Fermented drinks being classified as perishable goods or goods with a short shelf life.
- 3.2.2. Fermented beverages being classified as packaged goods that, once unpacked, are unsuitable for return due to damaged packaging and/or changes in individual physical properties.
3.3. The Buyer has other rights provided by these Rules and the laws of the Republic of Lithuania.
4. Buyer’s Obligations
4.1. The Buyer must pay for the goods and their delivery, as well as any other applicable charges, and accept the ordered goods.
4.2. If the Buyer’s registration details change, they must update the information immediately.
4.3. The Buyer must comply with other requirements set forth in these Rules and the laws of the Republic of Lithuania.
5. Seller’s Rights
5.1. The Seller reserves the right to change, suspend, or terminate certain functions or parts of them and to change the layout of elements on bactohouse.eu. These changes do not affect contracts concluded before such changes.
5.2. The Seller can cancel the order without prior notice if the Buyer does not pay for the goods within 2 working days when using electronic banking or electronic payment systems “Paysera” and/or “Paypal”.
5.3. The Seller can cancel the Buyer’s order without prior notice if:
- 5.3.1. The Seller cannot contact the Buyer within 2 business days after the order is placed.
- 5.3.2. The Buyer does not provide requested information within the specified timeframe.
- 5.3.3. The Buyer does not consent to the verification of personal data.
5.4. If the Buyer attempts to harm the operation or stability of the online store, the Seller may restrict, suspend, or terminate the Buyer’s access without prior warning and is not responsible for any related losses.
5.5. The Seller has the right to unilaterally change these Rules by publishing them on the online store’s website. Changes take effect upon publication for all transactions concluded thereafter.
5.6. The Seller has other rights as provided by these Rules and the laws of the Republic of Lithuania.
6. Seller’s Obligations and Warranty
6.1. The Seller undertakes to make efforts to enable the Buyer to use the services provided by the online store properly.
6.2. If, due to important circumstances, the Seller is unable to deliver the ordered goods, the Seller undertakes to offer a similar product. If the Buyer refuses the substitute product, the Seller will return the payment within 14 calendar days if prepayment was made, and in all cases, cancel the order.
6.3. If the Seller disagrees with the Buyer’s claims, they must provide a detailed, motivated written response within 10 calendar days from receiving the Buyer’s application, unless otherwise stipulated by the laws of the Republic of Lithuania and the European Union.
6.4. The Seller guarantees the quality of the goods.
6.5. The Seller undertakes to comply with other requirements set forth in these Rules.
7. Guarantee of Good Quality and Term of Suitability for Use
7.1. The characteristics of each product sold by bactohouse.eu are indicated in the product description attached to each product.
7.2. The goods offered by the Seller are of suitable quality, meaning the characteristics of the goods correspond to their descriptions.
8. Liability
8.1. The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer assumes responsibility for any consequences arising from incorrect or inaccurate data provided in the registration form.
8.2. The parties are responsible for any violations of the purchase and sale contract concluded through the electronic store in accordance with the legal acts of the Republic of Lithuania.
